The National Assembly of Pakistan has passed a bill that will strip the office of the Chief Justice of Pakistan of the power to take suo motu notice in an individual capacity. The Supreme Court (Practice and Procedure) Bill 2023 was presented by Federal Minister for Law and Justice Azam Nazeer Tarar and was passed soon after the Standing Committee on Law and Justice approved the cabinet’s proposed amendments. The bill aims to make apex court proceedings transparent and includes the right to appeal. The Pakistan Bar Council welcomed the move, having previously demanded that the criteria for suo motu jurisdiction be decided. The bill has been passed despite criticism from PPP Chairman Bilawal Bhutto Zardari, who believes it should be called a “judges empowerment” bill. The legislation also clarifies the constitution of benches and the use of the Supreme Court’s original jurisdiction.
