The Supreme Court of Pakistan resumed the hearing of a petition filed by the Pakistan Tehreek-e-Insaf (PTI) challenging the decision of the Election Commission of Pakistan (ECP) to postpone the general elections for the Punjab Assembly. The case is being heard by a five-member bench, which includes Chief Justice of Pakistan Umar Ata Bandial, Justice Ijazul Ahsan, Justice Munib Akhtar, Justice Aminuddin Khan, and Justice Mandokhail. During the proceedings, the Chief Justice of Pakistan asked whether the election date could be extended, and noted that the question in front of the court was simple. The coalition parties of PML-N, PPP, and JUI-F submitted a request to become respondents in the case. The Attorney General of Pakistan, PPP lawyer Farooq H. Naek, and others were present during the proceedings. The judges discussed whether the ECP had the authority to extend the election date, and expressed concern about the deteriorating security situation in the country and the unavailability of finances and security personnel. The attorney general referred to the dissenting notes of two SC judges, who cast doubt on the judgement handed down in the March 1 suo motu regarding elections in Khyber Pakhtunkhwa and Punjab. The Chief Justice of Pakistan stressed the importance of elections for democracy and urged the parties to respect all national institutions and work within their constitutional limits.
Chief Justice of Pakistan has stated that elections can only be postponed if an emergency is imposed in the country, and it is not possible to postpone the entire elections due to issues in specific areas. This statement was made during a hearing related to the delay of local body elections in Punjab and Khyber Pakhtunkhwa. The Pakistan Tehreek-e-Insaf (PTI) lawyer had argued that the election commission did not have the power to postpone the polls, while the court pointed out that the commission had the power to implement the Election Act, 2017. The Attorney General of Pakistan argued that the government was asked for funds and security for the elections, and he would present details on the matter after taking a briefing from the finance secretary.
