Renowned legal expert Barrister Aitzaz Ahsan commended Chief Justice of Pakistan (CJP) Justice Umar Atta Bandial for taking a firm stance against the doctrine of necessity. Speaking at a lawyers' convention in Islamabad on Monday via video link, Ahsan stated that the Constitution of Pakistan requires elections to be held within 90 days of the dissolution of an assembly. A group of lawyers had gathered in the federal capital to express their support for CJP Bandial, who headed a three-judge bench hearing the election delay case. The verdict was reserved by the chief justice following six hearings.
Ahsan lauded CJP Bandial for standing steadfastly against the doctrine of necessity and his fellow judges for supporting him in this cause for the Constitution's sake. He pointed out that dictation given to a judge by the family of Nawaz Sharif in the past is on record, and that the doctrine of necessity, which is Justice Munir's legacy, was responsible for imposing martial law in the country.
Aitzaz Ahsan emphasized that the constitution mandates holding elections within 90 days, as on the 91st day, the caretaker government becomes ineffective. He expressed concern that efforts are being made to avoid holding elections in Punjab and Khyber Pakhtunkhwa. Ahsan also alleged that those responsible for providing security during the elections are trying to prevent them from taking place. He stated that it is the first time he has seen the Constitution not being implemented. Ahsan further claimed that Interior Minister Rana Sanaullah will not allow the Rangers to stand guard during the elections since the paratroopers are under his control.
